§1: General provisions​

  1. These Regulations define the rules for making purchases and using services electronically as part of the service available on the website www.dekoala.pl ("DEKOALA").
  2. The administrator is SUPRAPRINT Kwiatkowski Sp. z o. o., registered in Pruszków, 5 Domaniewska Str, Poland, entered into the National Court Register under the number 0001110165, NIP: PL5271005265.
  3. The Regulations define the conditions and principles of using the DEKOALA Online Store, as well as the scope of liability.
  4. By using the services of the DEKOALA Online Store, the user confirms that he or she has read the Regulations and accepts all its provisions, also committing to comply with its provisions.
  5. All contractual relations between DEKOALA and customers are subject to the general terms and conditions. Any deviations will only be considered if they have been previously confirmed between DEKOALA and the customer in writing or have been expressly stated in these general terms and conditions.
  6. The customer undertakes to provide complete and truthful data in the order form. Providing false data will result in the Customer being liable for any resulting damages.
  7. In matters not regulated in the Regulations, in particular when submitting declarations of will in electronic form, the provisions of the Civil Code shall apply.

§2: Conclusion of the contract

  1. Images and any other products presented by DEKOAL on the Internet or other media do not constitute a commercial offer within the meaning of Article 534 of the Civil Code, but only an invitation to the customer to present a purchase offer. Purchase offers can be submitted via online order forms prepared by DEKOALA.
  2. The order placed by the Customer constitutes the conclusion of a purchase and sale agreement and is based on the applicable Regulations. Each ordered item must be configured by the customer according to his wishes. Be sure to explore all configuration options and consider the total price. All prices are always including tax and excluding shipping costs.
  3. The offered articles are only sample motifs. The client does not receive the original image, but only a copy consistent with the motif, prepared on the selected medium and according to the selected technique.
  4. After placing the order, the customer is sent an e-mail with a summary of his purchases. The beginning of the order processing period is the next business day after the day on which the payment was accepted or recorded.
  5. DEKOALA reserves the right to refuse to provide the service and fulfill the order if the products contain content that is contrary to the law, good customs or principles of social coexistence. The store also reserves the right to change the prices of goods on offer, as well as to change the costs of delivering the ordered items.

§3: Available payment methods

Payment is considered completed once the payment is credited to your account. Placing an order and receiving payment is confirmed via e-mail.

  1. Electronic payment in the online payment system.
  2. Prepayment by bank transfer to the account number provided in the order summary.

§4: Delivery terms

  1. The ordered items are sent to the customer via a courier company.
  2. Personal collection is possible at: DEKOALA Domaniewska 5, 05-800 Pruszków, from 9.00 a.m. to 5.00 p.m.
  3. Each product in the store's offer has an approximate delivery time. This date is estimated and due to production factors is not guaranteed. It is counted from the moment the payment is credited to our account. Orders with different lead times are sent after the entire order is completed, i.e. after the longest of the specified times. In justified cases, the store reserves the right to send each product as a separate shipment.
  4. Delivery costs are calculated for an individual order and appear in the Configurator as the final price. The delivery cost is charged to each order regardless of the form of delivery.
  5. In the event of delivery of goods that does not comply with the provisions of the contract due to our fault, the customer undertakes to give us an additional deadline of 2 weeks to complete the order.

§5: Damage caused during transport

  1. The buyer should check the condition of the shipment when receiving it from the courier. If you find that the contents are damaged or show signs of opening, do not acknowledge receipt of the shipment, but ask the courier to prepare a damage report.
  2. The customer is obliged to inform the store as soon as possible about an attempt to deliver a damaged shipment.

§6: Limitation of liability

  1. DEKOALA is not responsible for the lack of permanent access to the Online Store and the speed of the system, as well as for technical and electronic errors occurring when placing an order, if they are caused by factors beyond the store's control.

§7: Dimensional tolerance

  1. For printed decorations, the dimensional tolerance is approximately:
  • wallpaper and wall mural +/- 5 mm
  • canvas, panels and posters +/- 2 mm
  • fabrics (curtains, drapes, tablecloths, blankets, cushion): +/- 1%
  • photo blinds +/- 2 mm

§8: Color compatibility

  1. Due to the CMYK color palette used in production, please remember that many colours displayed on monitors will differ from those printed in reality. This especially applies to files:
  • saved in RGB mode
  • containing additional Pantone or RAL colours
  • metallic colours (gold, silver)
  • fluorescent colors

All standards listed above will be obtained by converting to the CMYK ink palette to obtain the closest similar color, but there is no guarantee that it will be identical.

§9: Product visualizations

  1. The product visualizer is a decoration proposal and is for illustrative purposes only.
  2. Due to the scale and the inability to assess all parameters on the monitor, the product visualizer does not reflect 100% compliance.
  3. Discrepancies may concern:
  • colours details
  • size accuracy
  • proportions
  • transparency
  • method of finishing

§10: Care

  1. Printed decorations can be subjected to appropriate care, but special attention should be paid to the type of product ordered.
  2. It should be taken into account that textile decorations (curtains, drapes, tablecloths, pillows, blankets) will tend to shrink depending on the washing temperature.
  3. Recommended care method:
  • standard wallpaper - can be wiped with a slightly damp cloth
  • washable wallpaper, self-adhesive wallpaper, self-adhesive fabric - can be wiped with a damp cloth with mild detergents
  • canvvas prints - can be wiped with a slightly damp cloth
  • posters - can be wiped with a dry cloth
  • fabric decorations - can be washed at low temperatures using mild detergents

§11: Right to withdraw from the terms of the contract

  1. DEKOALA is a service for printing personalized decorations upon request. The customer himself determines the parameters of the order by initially selecting the photo, material, print size, up to the selection of possible product finishing options. Production is carried out from scratch according to specific features at the customer's request. Apart from the exceptions described in detail in Art. 8 on the terms of complaints. The customer has no possibility to withdraw from the contract.
  2. Due to the above, the right to withdraw from the contract pursuant to Article 7(1) (i.e. return of goods within 10 days without giving a reason) is definitely not available in the case of the following contracts:
  • producing personalized products whose features were defined by the Customer in the order or serve to meet his individual requirements,
  • production of products that, based on the order placed, become inextricably linked to other items, taking into account their characteristic features,
  • regarding the delivery of goods that have been prepared and manufactured at the customer's special request, including photo wallpapers, paintings, posters, panels and other products available in the DEKOALA store,
  • regarding goods that have been ordered and will be used for the Customer's business purposes

§12: Complaints and returns

  1. DEKOALA provides a 12-month warranty for the purchased goods, which is valid from the date of delivery of the product to the Customer.
  2. Slight differences between the delivered product and the one offered in the store cannot constitute grounds for a complaint. Minor deviations are considered to be minor differences in the size, type and quality of the substrate, which are technologically unavoidable in the production process. Differences in the color of the actual product from the color of the product reproduced on the computer monitor cannot be the basis for a complaint. The color reservation applies especially to metallic and fluorescent colors and colors that go beyond the CMYK table. The store will also not accept complaints in the event of improper handling of the product by the Customer or improper installation.
  3. The Seller is liable to the buyer (customer) if the sold item has a defect that reduces its value or usefulness, if the item does not have the properties of which the store assured the Customer, or if the item was delivered to the Customer incomplete. In such a case, the Customer may demand that the product be brought to the condition consistent with the contract by free repair or replacement with a new product.
  4. Complaints are accepted if the Customer reports in writing (by e-mail or traditional mail) a noticeable defect in the goods or an incorrect delivery within 2 weeks from the date of delivery of the goods.
  5. If DEKOALA delivers an item free of defects as a complement to the delivery, it may demand the return of the defective goods from the Customer.

§13: Withdrawal from the terms of the contract by the seller

  1. DEKOALA zastrzega sobie prawo do odstąpienia od warunków umowy bez możliwości roszczenia odszkodowawczego ze strony Klienta w ciągu 7 dni od jej zawarcia w przypadku, gdy wystąpiły okoliczności niezależne od DEKOALA., których nie można było przewidzieć. Podstawą odstąpienia w wyznaczonym terminie jest także ingerencja w strukturę sklepu przez osoby trzecie, na skutek czego uległa zmianie funkcjonalność, parametry serwisu oraz mechanizm składania zamówień i ceny.
  2. DEKOALA zastrzega sobie prawo do odstąpienia od realizacji:
  • orders violating the personal rights of third parties,
  • orders containing any form of violence, profanation, pornography and content contrary to applicable legislation and generally accepted standards.

§14: Copyright

  1. The purchase of goods does not constitute the acquisition of any copyright or other intellectual property rights to the purchased products.
  2. The products sold by DEKOALA are subject to worldwide copyright. The customer or third parties are not authorized to produce, distribute or reproduce DEKOALA products.

§15: Personal data

  1. By registering in the online store, the customer also consents to the processing of his personal data to the extent necessary to perform the concluded contract.
  2. The Customer's personal data provided are protected in accordance with the Act of August 29, 1997. about personal data protection. DEKOALA will make every effort to minimize the possibility of unauthorized access to this information by third parties.
  3. Personal data is not made available to other entities for marketing purposes.

§16: Final provisions

  1. In matters not regulated by these Regulations, the provisions of the Civil Code or other legal regulations relating to the operation of websites and online stores shall apply.
  2. DEKOALA reserves the right to make changes to these Regulations.
